  1. Rules: These rules apply to participation in the “Hill’s Online Training Academy” platform (“Platform”). By participating in the Platform, you agree, on behalf of yourself, all employees and the outlet (“Outlet”) with whom you are employed, to be bound by these rules. If you do not agree to these rules, you must not participate in the Platform. The Promoter reserves the right, acting reasonably, to disqualify participants who do not comply with these rules.
  2. Who may participate: Any staff who is employed at a participating Outlet distributing Hill’s pet food in South Africa and Namibia, or any Hill’s Breeder, Puppy School, Shelter or In-Store Promoter who is over the age of 18 (“Staff Member” or “Hill’s Partner”). ("Criteria"). The Platform is not open to members of the public, directors, members, partners, employees, or consultants of the Promoter, any person who controls the Promoter, or any supplier of goods or services in connection with the Platform, or their respective spouses, life partners, business partners or immediate family members.
  3. How to participate:
    • A user must visit www.HillsAcademy.co.za and register using their personal details, including a unique personal email address.
    • The Outlet information is to be supplied by the user registering on this platform.
    • You acknowledge and agree that there may be certain secured areas of this site that will not be available to all users and will be limited solely to eligible, registered users. If you are a registered user of a secured area within this site, your user id and password will give you access to that particular secured area. You are responsible for maintaining the confidentiality of your password, and you are solely responsible for all information and/or instructions that you transmit through this site using your user id and password.
    • You acknowledge and agree that all materials, including, without limitation, content, data, software, information, products and services, contained on or provided through this site or marketing materials used to participate in the Hill’s Training Academy and/ its courses (“Materials”) placed by Hill's Pet Nutrition Limited or its group companies and Colgate-Palmolive Company are copyrighted. The brand names, logos, labels and package designs ('trademarks') that appear on this site belong to Hill's Pet Nutrition Inc., its group companies or its licensors where noted. By placing these trademarks on the site, Hill's is not granting a license to use or reproduce them. Notwithstanding the foregoing, you may download or print single copies of Materials for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices. The content may not be otherwise copied and may not be modified.
    • The Promoter and its affiliates are not responsible for any problems or technical malfunction of any telephone or mobile network, computer system, server, or provider which may have hindered submission into this Platform.
    • The Promoter reserves the right, at its sole discretion, to remove a user if they do not adhere to the platform criteria based on the information submitted.
  4. Promoter’s Decision: The decision of the Promoter in all matters is final and binding on you and no correspondence will be entered into.
  5. Cancellation and amendment: The Promoter reserves the right, acting reasonably, to cancel or amend the content on the Platform. The Outlets are entitled to withdraw from using the Platform if they do not agree with any amendments made by the Promoter. As far as the law allows, if the Promoter cancels the Platform or amends these rules, the Outlets will have no claim against the Promoter. The paragraph above is important. It:
  6. Participant's warranties: You represent and warrant that the information provided is true and accurate. Should the information be incorrect or require to be updated, kindly contact Hill’s head office to update such information.
  7. No warranties and exclusion of liability: As far as the law allows, and subject to 12:

(i) all warranties and representations in relation to the reimbursement not set out in these rules (whether express, implied or tacit) are hereby excluded;

(ii) the Promoter, their associated companies, and their respective directors, officers, employees and agents will not be liable for any loss or damage, whether direct, indirect, consequential or otherwise, arising from any cause which may be suffered as a result of participating in the Platform, the provision or use of the reimbursement, or any act or omission of any other person.

This clause 9 does not purport to limit or exempt the Promoter for any loss directly or indirectly attributable to their gross negligence or that of any person acting for or controlled by them.

The paragraph above has important consequences for you. In this paragraph:

  • the legal responsibilities and liability of the Promoter and other persons are excluded or limited;
  • the rights you have against the Promoter are limited or excluded; and
  • you take on the responsibility and liability for certain losses or damages or events that might happen. You participate in the Platform accepting that these things can go wrong and that there are risks.

10. Law and jurisdiction: These rules shall be governed by the laws of South Africa. The participant consents to the non-exclusive jurisdiction of the Western Cape High Court of South Africa, Cape Town in respect of all matters arising out of or in connection with the Platform or these rules.

11. Severability: If any provision of these rules is found to be invalid or unenforceable by any court of competent jurisdiction, then that provision shall be severed from these rules and shall not affect the validity or enforceability of any remaining provisions.

12. Consumer Protection Act: It is not intended that any provision of these rules contravenes any provision of the Consumer Protection Act, 68 of 2008, and therefore all provisions of these rules must be treated as being qualified, if necessary, to ensure that the provisions of the Consumer Protection Act are complied with.
